5. Custody of Funds and Segregation

5.1 Custodian of Funds

   a. Custodian: VantageMarkets serves as the custodian for client funds. All client funds are held in segregated bank accounts, separate from VantageMarkets’ operational funds. 

   b. Regulatory Numbers:

      - VantageMarkets: autorised and regulated by the Cayman Islands Monetary Authority (CIMA), Securities Investment Business Law (SIBL) number 1383491. 

      - London & Eastern LLP (Pelican Trading): authorised and regulated by the Financial Conduct Authority in the UK, ref 534484. Registered address: 85 Great Portland Street, First Floor, London, W1 W7LT 

   c. No Custody by InfinityGlobal: InfinityGlobal Holding LTD does not hold or take custody of any client funds directly. Our role is limited to providing marketing services and strategy provision.

5.2 Account Segregation

   a. Separation of Funds: VantageMarkets ensures that client funds are segregated from its operational funds, in accordance with regulatory requirements. This segregation is intended to protect your assets and ensure they are used only for trading activities on your behalf. 

   b. Audit and Compliance: VantageMarkets is subject to regular audits and regulatory oversight to ensure that client funds are managed in compliance with applicable regulations and industry standards.

5.3 Access to Funds

   a. Withdrawal Requests: You may request withdrawals of your funds from your account with VantageMarkets at any time, subject to their withdrawal policies and procedures. 

   b. Processing Times:Withdrawal requests are generally processed promptly, but processing times may vary based on factors such as the method of withdrawal, regulatory requirements, and any potential verification procedures.

5.4 Custodian Responsibilities

   a. Safeguarding Assets: VantageMarkets is responsible for safeguarding your assets and adhering to regulatory requirements concerning the handling and custody of client funds. 

   b. Reporting and Disclosures: VantageMarkets provides regular reports and disclosures related to the custody of your assets, including account statements, transaction histories, and any other relevant information.

5.5 Dispute Resolution

   a. Dispute Procedures: Any disputes or concerns regarding the custody or management of your funds should be addressed directly with VantageMarkets. InfinityGlobal Holding LTD will cooperate with VantageMarkets to resolve any issues in accordance with applicable laws and regulations. 

   b. Regulatory Bodies: In the event of unresolved disputes, you may contact relevant regulatory bodies for assistance and resolution. These bodies are responsible for overseeing financial institutions and protecting investor interests.

6. Trading Solicitation

6.1 No Solicitation by InfinityGlobal

   a. Marketing and Strategy Role: InfinityGlobal Holding LTD operates solely as a marketing agency and strategy provider for VantageMarkets and London & Eastern LLP (Pelican Trading). We do not solicit or execute any trading activities. 

   b. Trading Solicitation by London & Eastern LLP: All trading activities and solicitation are conducted exclusively by London & Eastern LLP (Pelican Trading). InfinityGlobal Holding LTD does not engage in trading on your behalf or provide specific trading recommendations.

7. Modifications to Terms

7.1 Amendments

   a. Right to Modify: We reserve the right to modify these Terms at any time, at our sole discretion. Such modifications will be effective immediately upon posting on our website or through our platform. 

   b. Notification: We may provide notice of significant changes to these Terms through email or other communication channels. It is your responsibility to review the Terms regularly for any updates or modifications. 

   c. Acceptance of Changes: Your continued use of our Services after any modifications to the Terms constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must cease using our Services.

8. Termination

8.1 Termination by Us

   b. Final Settlement: Any remaining funds or positions in your account will be handled according to VantageMarkets' policies and procedures, including any applicable withdrawal or settlement processes.

   a. Applicable Law: These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles. 

   b. Legal Proceedings: Any legal proceedings related to these Terms or our Services must be conducted in the courts of Belgium.

9.2 Dispute Resolution

   a. Arbitration: Any disputes arising out of or relating to these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of CEPANI. 

   b. Arbitration Process: The arbitration will be conducted in Belgium, and the arbitrator’s decision will be final and binding. Judgment upon the arbitration award may be entered in any court having jurisdiction.
